Mitigation strategy

1. Establish Comprehensive IP Governance and Trade Secret Controls. Mandate written agreements (employment, contractor, and vendor NDAs) that clearly assign IP ownership and confidentiality obligations to the organization. Implement robust security protocols, including secure IT systems, limited access to proprietary data, and mandatory, recurring training for all stakeholders on IP policies and trade secret handling to prevent inadvertent or intentional disclosure. 2. Implement Proactive IP Clearance and Landscape Monitoring. Conduct mandatory patent and trademark clearance searches prior to all innovation, product development, and branding initiatives to mitigate the risk of inbound infringement. Establish a continuous, routine monitoring program of the competitive landscape and relevant markets to promptly detect and pursue proactive enforcement actions against unauthorized use of the organization's own copyrighted or trademarked assets. 3. Develop and Enforce an AI-Specific IP Policy and Due Diligence Framework. Mandate a cross-functional team to vet all third-party AI tools and platforms, prioritizing enterprise licenses with clear contractual terms regarding IP ownership, warranties, and indemnification for AI-generated content. Implement formal policies requiring the review and clearance of all AI-generated outputs before external deployment to ensure compliance with copyright laws and prevent plagiarism.
